TERMS OF SERVICE
Terms of Service
These terms govern the use of Airffic World OS (the “Service”). The Service deals with aircraft in the sky. Unlike software on the ground, a mistake in operation can harm people. Article 4, on safety and legal compliance, is the most important clause in these terms.
This is an English translation for convenience. If there is any conflict, the Japanese version prevails.
Article 1 (Application)
These terms set out the conditions for providing the Service and the rights and obligations between us and the user, and apply to every aspect of the relationship between the user and us concerning use of the Service.
By using the Service, the user is deemed to have agreed to these terms.
Article 2 (Accounts)
- Users shall register an account with accurate and up-to-date information.
- Users are responsible for keeping their account details and API keys safe. We accept no liability for use by a third party.
- One account may not be shared between several people.
Article 3 (What the Service provides)
The Service provides the following functions.
- Registration of drones and management of their identification details
- Recording of flight position data and display on a map
- Recording of building inspection work and support for producing reports
- Support for creating shift rosters
- Access to the above functions through an API
The Service neither guarantees the safety of a flight nor controls any aircraft automatically.Decisions about operations and the piloting itself are always the responsibility of the user.
Article 4 (Safety and legal compliance — the most important clause)
When using the Service, the user shall comply with the following.
- Comply with the Civil Aeronautics Act, all other applicable laws, and local government ordinances.Where airspace or a method of flight requires a permit or approval, complete the required procedures before flying.
- Fulfil all legal obligations concerning aircraft registration and Remote ID.
- When a flight involves photography, obtain permission from the manager of the subject and respect the privacy of third parties.
- Do not fly in a way that could cause harm to people or property.
Information shown in the Service is no substitute for the user’s own confirmation of the law.Final responsibility for whether a flight may take place always rests with the user as operator.
Article 5 (Prohibited conduct)
Users shall not do any of the following.
- Act in breach of the law or public order and morals
- Act in connection with a criminal offence
- Destroy or interfere with the functioning of the Service’s servers or network (including calling the API at an excessive rate)
- Register false aircraft information or false flight information
- Access or obtain other users’ data without authorisation
- Copy, republish, disassemble or decompile the Service
- Damage the reputation of the Service
Article 6 (Membership)
Membership of the Service covers the whole platform.It is not a contract for each individual app.
Members may use every app currently offered.Apps added in future are also available under the same membership, with no additional contract.We do not, however, guarantee whether or when any new app will be released.
There are two kinds of paid membership, Premium and First Class, which differ in the range of functions available. The specific conditions are published in the legal notice under the Specified Commercial Transactions Act.
Article 7 (Fees and payment)
- Fees and billing conditions for paid plans are as displayed in the Service.
- Payments are made through Stripe, Inc. Credit card details are collected directly by Stripe and are not held by us.
- Paid plans renew automatically on the same conditions unless the user cancels.
- No pro-rated refunds are given.After cancellation the plan remains usable until the last day of the current billing period.
Article 8 (Handling of data)
Aircraft information, flight position data and inspection data registered by the user are handled as set out in the Privacy Policy.
Rights in the data registered by the user belong to the user. We use it only to the extent necessary to provide the Service.
Article 9 (Suspension and interruption)
We may suspend or interrupt all or part of the Service without prior notice in the following cases.
- Maintenance, inspection or upgrade of equipment
- Force majeure such as earthquake, lightning, fire, power failure or other natural disaster makes provision difficult
- An external service we rely on (database, payments, maps and so on) is unavailable
- Any other case in which we judge that continuing to provide the Service is difficult
Article 10 (Disclaimer)
We do not guarantee any level of uptime for the Service.Where a separate contract guaranteeing uptime has been concluded, that contract governs.
We are not liable for damage suffered by the user through use of the Service, except where caused by our wilful misconduct or gross negligence. Where we are liable, the amount of compensation iscapped at the amount the user paid us in the preceding twelve months.
We accept no liability for injury to persons or damage to property arising from a flight.Responsibility for operations rests with the user, as set out in Article 4.
Article 11 (Changes to these terms)
We may change these terms, with notice to users, where we judge it necessary. The revised terms take effect from the time they are posted on this page.
Article 12 (Governing law and jurisdiction)
These terms are governed by the laws of Japan. Any dispute concerning the Service is subject to the exclusive jurisdiction of the court having jurisdiction over the location of our head office.
